Terms of Personal Data Protection

Article I. Basic Provision

The operator of personal data, in accordance with Section 5(o) of Act No. 18/2018 Coll. on the Protection of Personal Data, as amended (hereinafter referred to as the „Act“), is americansupplements.eu (hereinafter referred to as the „Operator“).

Personal data refers to all information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as name, identification number, location data, network identifier, or one or more factors specific to physical, physiological, genetic, mental, economic, cultural, or social identity.

Article II. Sources and Categories of Personal Data Processed

The Operator processes:

  1. Personal data provided by you.
  2. Personal data obtained based on fulfilling your order.

This includes identification and contact data necessary for performing the contract.

Article III. Legal Basis and Purpose of Personal Data Processing

The legal basis for processing personal data is:

  1. Performance of the contract between you and the Operator (§ 13(1)(b) of the Act).
  2. The Operator’s legitimate interest in direct marketing (§ 13(1)(f) of the Act).
  3. Your consent for direct marketing purposes (§ 13(1)(a) of the Act) if no goods or services have been ordered.

The purposes of processing personal data include:

  1. Fulfilling your order and exercising rights and obligations from the contractual relationship.
  2. Sending business announcements and conducting other marketing activities.

Article IV. Retention Period of Personal Data

The Operator retains personal data:

  1. For the duration necessary to fulfill rights and obligations arising from the contractual relationship and for 15 years after its termination.
  2. Once the retention period expires, personal data will be deleted.

Article V. Recipients of Personal Data

Recipients of personal data include:

  1. Persons involved in delivering goods/services or processing payments under the contract.
  2. Providers of e-shop operation services and related activities.
  3. Providers of marketing services.

Article VI. Your Rights

Under the Act, you have the following rights:

  1. Access your personal data (§ 21).
  2. Correct your personal data (§ 22) or restrict processing (§ 24).
  3. Request the deletion of your personal data (§ 23).
  4. Object to processing (§ 27).
  5. Request data portability (§ 26).
  6. Withdraw consent to processing by written or electronic request to the address or email specified in Article III.

You also have the right to file a complaint with the Office for Personal Data Protection if you believe your rights have been violated.

Article VII. Terms of Personal Data Security

  1. The Operator has implemented appropriate technical and organizational measures to secure personal data.
  2. Only authorized persons have access to personal data.

Article VIII. Final Provisions

  1. By submitting an order via the online form, you confirm that you are familiar with and accept these terms in full.
  2. You agree to these terms by checking the agreement box on the online form.
  3. The Operator reserves the right to update these terms and will publish the new version on its website and notify you via email.

These terms take effect on September 5, 2018.
